This Privacy Policy applies exclusively to the website (www.madeinmarket.eu) of IMPECCABLE PLACE - WAREHOUSE & DISTRIBUTIONS LDA. and aims to inform its users, holders of personal data, the processing of personal data that is carried out, and the principles and duties observed with regard to the protection of personal data.

MADE IN MARKET® undertakes to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 - General Data Protection Regulation (GDPR) and with all other applicable data protection legislation, including national legislation complementing the GDPR, and as such to communicate in a transparent manner about the personal data processed and the type of processing it performs, to protect the security, privacy, and confidentiality of personal data, to make available the mechanisms necessary for the exercise of the rights of the owners of personal data concerning them, to provide security systems designed to prevent the consultation, modification, destruction or addition of personal data by third parties not authorized to do so and to detect any misuse of information, and to develop organizational measures to maintain control of personal data by their owners.

MADE IN MARKET® is the entity responsible for the operation of this website, and ensures the privacy and confidentiality of personal data collected through it (information relating to identified or identifiable natural persons) in accordance with the requirements of the General Data Protection Regulation - RGPD, assuming itself as "Responsável pelo Tratamento", deciding the data to be processed, the means of processing such data and the purposes for which they are processed, having for this purpose security systems and organizational measures to prevent the consultation, modification, destruction or addition of personal data by unauthorized persons and that allow detecting any misuse of information.

Personal Data Processed and Purposes of Processing

MADE IN MARKET® respects your right to privacy; therefore, navigation on the website does not require any registration process or the disclosure of any personal information, and there is no automated collection of personal data.

However, some functionalities require the availability of personal data, so if the user wishes, he or she may leave information, which consists of the supply of personal data and which is collected through the "contact us form'', the “online account creation" or still, by filling in the "field to receive the newsletter". In case of a contact request, the personal data collected are the full name, email, and cell phone number; in case of online account creation, the personal data are the e-mail or username and password, both created by the owner of the personal data; and finally, in case of filling in the field to receive the newsletter, the personal data provided is the email address.

The purpose of the collection of the above-mentioned personal data is, respectively: to contact the holder of the personal data for the purpose of providing the requested information, answering any questions, or managing any complaints; to allow the creation and management of a personal online account that operates in a personal area of the website created for the purpose for the holder of the personal data of such account; and to send the newsletter developed by MADE IN MARKET® until otherwise indicated by the holder of the personal data of the subscriber of the same.

In addition to the personal data mentioned above and the purposes for which they are intended, online orders, the corresponding home deliveries, as well as the issuance of the respective invoices corresponding to the orders placed, require the collection of certain personal data by MADE IN MARKET® and have purposes defined as follows, respectively name, e-mail, telephone contact, address, and bank details are indispensable in the order process, to manage the order process; name, e-mail, telephone contact and address are essential to proceed with home delivery of the order, for delivery at the place desired by the data subject; name, taxpayer number, address, are the personal data collected to issue the invoice and which are requested as required by law. 

MADE IN MARKET® is solely responsible for the collection and processing of personal data carried out through the fields described above on its website, and the personal data collected through such fields are solely and exclusively those indispensable to ensuring the identity of the person to be contacted by the Person Responsible for Treatment and strictly used for the purposes described above.

The personal data collected, provided by the owner of the personal data, is processed with the security and confidentiality guarantees required by the General Data Protection Regulation (GDPR) and other legislation in force concerning this matter, including the National Implementation Law of the GDPR.

If MADE IN MARKET® intends to use the data collected for a purpose other than that for which it received proper authorization, it will request new authorization for specific use.

Grounds of Lawfulness

MADE IN MARKET® processes personal data for purposes duly defined based on the following legal grounds: conclusion, execution, and management of a contract; compliance with a legal obligation; prior, express, written, explicit, informed, free, and specific consent; and legitimate interest.

Periods of Conservation

MADE IN MARKET® will keep, for a maximum period of 3 (three) years, the personal data supplied in the context of "contact us", will keep, until further notice, the personal data supplied in the context of creating an online account or delete them after 3 (three) years of inactivity on the website, will keep, until further notice, the personal data supplied in the context of the request to receive a newsletter keeps the personal data supplied for the on-line order for the period necessary to carry out the order on-line, keep the data supplied for home deliveries for a period of 1 (one) year after the last use of the service, and keeps the personal data supplied for billing purposes for the periods defined by law.

Thus, the personal data of the owners that is collected through this website is kept for the period strictly necessary for the purpose that determined their collection and use, up to a maximum period of 3 years.

However, they may be retained for a period different from that determined above in the event of other interactions between the data subject and MADE IN MARKET®, including the execution of a contract, or if the data processing is required by law. 

Rights of the Data Subject

The user of this website and the holder of the personal data are guaranteed the exercise of the following rights:

Right of Access: The right of access is the right of the data subject to obtain confirmation as to whether or not personal data concerning him is being processed. And, if so, the right of access to your data and to certain information such as the purpose of the processing, the categories of data concerned, the recipients or categories of recipients to whom the data have been or will be disclosed, whether those recipients are established in third countries or whether they belong to international organizations, the envisaged period for which the personal data will be stored, or if this cannot be ascertained, the criteria used to fix the period.

Right of Rectification: The right of rectification is the right to have inaccurate personal data concerning the user and data subject rectified. In the case of incomplete data, the data subject has the right, through an additional declaration, to have his or her data completed with the information contained in such a declaration.

Right to Portability: The right to portability enables the data subject to receive personal data in a structured, commonly used, and machine-readable format and to transmit the data to another controller, without the controller to whom the personal data have been provided being able to prevent this. For this purpose, the processing must be based on specific consent to this effect or a contract, and it must have been carried out by automated means.

Right to object: The right to object gives the holder of personal data the right to object at any time, on grounds relating to his or her particular situation, to the processing of his or her data, where such processing is necessary for the legitimate interests pursued by MADE IN MARKET® or by third parties, unless the latter provide compelling legitimate grounds for such processing that override their interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims. Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to the processing of his or her data for the said purpose.

Right to Erasure: This is the right that legitimizes the data subject to obtain the erasure of his or her data when it is no longer necessary for the purpose that motivated their collection and processing, if consent is withdrawn and this is the sole ground for processing the data, if there is no legal ground for the processing, if exercising the right to object to the processing, if there are no compelling legitimate interests that justify the processing, if the data is unlawfully processed, or in the last instance, if the data must be erased to comply with a legal obligation arising from Union or Member State law to which the controller is subject.

Right to be forgotten: The right to be forgotten is the right to request the erasure of your data, provided that there are no valid grounds for keeping it.

Right to Limitation: The right to limitation allows a limitation of processing if you challenge the accuracy of the personal data for a period that allows the controller to verify its accuracy if the processing is unlawful and the data subject objects to the erasure of the personal data and requests in return the limitation of its use if the controller no longer needs the personal data for the processing but they are required by the data subject for the establishment, exercise, or defense of legal claims, or in the last instance where the data subject has exercised the right to object until it is established that the legitimate interests of the controller override those of the data subject.

Non-subjection to automated decisions only: This consists of the right to request that there be human intervention or to contest decisions based on fully automated processing of personal data that may have significant effects on their legal or private life spheres, subject to the exceptions arising from the legislation in force.

Complaint to the CNPD: This includes the right to present complaints to the CNPD (National Commission for Data Protection).

How to Exercise the Rights of the Personal Data Holder

The holder of personal data may at any time exercise any of the rights identified and described in number 7 (seven) of this Privacy Policy by contacting MADE IN MARKET®, using the e-mail address dpo@madeinmarket.eu and identifying the right(s) you wish to exercise. 

The holder of personal data also has the right to lodge complaints with the National Commission for Data Protection (CNPD) on matters concerning the exercise of their rights and the protection of their data, with headquarters at Av. Sharing of Personal Data with Third Parties 

The personal data collected on this website is not shared with third parties, except with the providers of IT, technical, and operational support services.

If the visitor to the website performs any activity that involves the sharing of his or her data with third parties, he or she will be duly informed, just as he or she will be informed of the identity of the third parties concerned and the purpose of the processing of the personal data shared.

Revisions and Changes to the Privacy Policy
